Brazil launches second anti-dumping sunset review investigation on Chinese cold-rolled stainless steel sheets

On October 2, 2024, the Foreign Trade Secretariat of the Ministry of Development, Industry, Trade and Services of Brazil (Ministério do Desenvolvimento, Indústria, Comércio e Serviços/Secretaria de Comércio Exterior) issued Announcement No. 51 of 2024, initiating the second anti-dumping sunset review investigation on stainless steel cold-rolled sheets [Portuguese: laminados planos de aços inoxidáveis austeníticos tipo304 (304, 304L e 304H) e deaços inoxidáveis ferríticostipo 430, african laminados, igual ou superior a 0.35 mm, inferior a 4.75 mm] originating in mainland China and Taiwan, in response to an application submitted by Aperam Inox América do Sul S.A., a domestic Brazilian company, on April 29, 2024. The products involved are flat-rolled austenitic 304 (304, 304L, and 304H) stainless steel and cold-rolled ferritic 430 stainless steel with a thickness of 0.35 mm or greater and 4.75 mm or less. They fall under Mercosur tariff codes 7219.32.00, 7219.33.00, 7219.34.00, 7219.35.00, and 7220.20.90.

The dumping investigation period for this case runs from January to December 2023, and the injury investigation period runs from January 2019 to December 2023. The announcement is effective from the date of publication.

On April 13, 2012, Brazil initiated an anti-dumping investigation into cold-rolled stainless steel sheets originating in mainland China, Taiwan, South Africa, Germany, South Korea, the United States, Finland, and Vietnam. On July 27, 2012, Brazil issued negative final anti-dumping rulings on products originating in South Africa and the United States. On October 14, 2013, Brazil issued affirmative final anti-dumping rulings on products originating in mainland China, Taiwan, Germany, South Korea, Finland, and Vietnam. On October 3, 2018, Brazil initiated its first sunset review of anti-dumping investigations on cold-rolled stainless steel sheets originating in mainland China, Taiwan, Germany, South Korea, Finland, and Vietnam. On October 2, 2019, the Brazilian Ministry of Economy issued Decree No. 4.353, continuing to impose anti-dumping duties on cold-rolled stainless steel sheets originating in mainland China and Taiwan for a period of five years and not extending the anti-dumping duties on products originating in Germany, South Korea, Finland, and Vietnam.
